1. Introduction & Acceptance
Welcome to SongCraft (“we”, “us”, “our”). By accessing or using our website, mobile application, or any related services (collectively, the “Service”), you agree to be bound by these Terms of Service (“Terms”). If you do not agree with any part of these Terms, you must not use our Service.
SongCraft provides a platform where real musicians use AI-assisted tools to create bespoke, personalised songs based on information you provide. These Terms govern your relationship with us when you browse our site, place an order, or interact with any part of our Service.
2. Eligibility
You must be at least 16 years of age (or the age of digital consent in your jurisdiction, whichever is higher) to use our Service. By using SongCraft, you represent and warrant that you meet this requirement. If you are under 18, you confirm that you have the consent of a parent or legal guardian.
3. Account Registration
Certain features of the Service require you to create an account. You agree to provide accurate, current, and complete information during registration and to keep your account credentials secure. You are solely responsible for all activity that occurs under your account. You must notify us immediately at [email protected] if you suspect any unauthorised use of your account.
We reserve the right to suspend or terminate accounts that contain false information, are used in violation of these Terms, or remain inactive for an extended period.
4. The Service & How It Works
SongCraft enables you to commission personalised songs. Here is what you should know:
- Human-crafted with AI assistance: Every song is guided by a real musician who reads your input and uses AI tools as creative instruments. The final output is a human-curated work.
- Your input matters: The quality of your song depends significantly on the detail and emotion you share with us. We encourage you to be as specific and heartfelt as possible.
- Delivery times: While we aim to deliver songs promptly, generation times can vary. We do not guarantee specific delivery deadlines unless expressly stated at the point of purchase.
- Content review: We reserve the right to decline or modify requests that contain hateful, defamatory, illegal, or otherwise objectionable content.
5. Pricing & Payment
All prices are displayed in British Pounds Sterling (£) and include applicable taxes unless otherwise stated. Our current pricing is:
- First song: £25
- Each additional song in the same order: £15
We reserve the right to change our pricing at any time. Any price changes will not affect orders that have already been placed and confirmed. Payment is required at the time of order. We use secure third-party payment processors and do not store your full payment card details on our servers.
6. Refunds & Cancellations
Because each song is a bespoke, custom-made product created specifically for you:
- Before generation begins: You may cancel your order for a full refund by contacting us at [email protected].
- After generation has started: Refunds are not available for songs that are in progress or have been completed, as these are personalised digital products exempt from the standard 14-day cooling-off period under the Consumer Contracts Regulations 2013 (UK).
- Quality concerns: If you are genuinely dissatisfied with the quality of your song, please contact us within 14 days of delivery. We will review your case on an individual basis and may offer a revision, credit, or partial refund at our discretion.
7. Intellectual Property & Licensing
7.1 Your Content
You retain ownership of any personal stories, names, phrases, and other content you submit to us (“Your Content”). By submitting Your Content, you grant SongCraft a non-exclusive, worldwide, royalty-free licence to use, reproduce, and process Your Content solely for the purpose of creating and delivering your commissioned song.
7.2 The Song
Upon full payment, you receive a personal, non-exclusive, perpetual licence to use, play, share, and gift your completed song for private, non-commercial purposes. This includes playing it at personal events, sharing it on social media, and gifting it to the intended recipient.
You may not: sell, sublicense, distribute commercially, use the song in advertising or commercial media, or claim authorship of the musical composition. SongCraft and the contributing musician(s) retain all underlying copyright in the musical composition and sound recording.
7.3 SongCraft IP
All content on our website — including but not limited to text, graphics, logos, icons, audio clips, software, and the design and arrangement thereof — is the property of SongCraft or its licensors and is protected by copyright, trademark, and other intellectual property laws.
8. User Conduct
When using our Service, you agree not to:
- Submit content that is defamatory, obscene, threatening, harassing, or promotes violence or discrimination
- Infringe upon the intellectual property rights of others (e.g., requesting lyrics that copy existing copyrighted songs)
- Use the Service for any unlawful purpose or to solicit unlawful activity
- Attempt to gain unauthorised access to our systems, other users' accounts, or data
- Interfere with or disrupt the integrity or performance of the Service
- Use automated means (bots, scrapers, spiders) to access the Service without our prior written consent
- Impersonate any person or entity, or misrepresent your affiliation with any person or entity
9. Privacy & Data Protection
We take your privacy seriously. Our collection, use, and protection of your personal data is governed by our Privacy Policy. By using the Service, you acknowledge that you have read and understood our data practices.
Key points: we collect only the data necessary to provide the Service (account details, song input content, payment information). We do not sell your personal data to third parties. Personal stories and song input content are used solely for song creation and are treated as confidential.
10. AI & Technology Disclosure
SongCraft uses artificial intelligence technology as a creative tool in the song-making process. We are transparent about this: AI assists with lyric drafting and music generation, but every song is reviewed, refined, and curated by a real human musician.
While we strive for the highest quality, AI-generated content may occasionally produce unexpected results. Our musicians review all output before delivery to ensure quality standards are met.
11. Limitation of Liability
To the maximum extent permitted by applicable law:
- SongCraft shall not be liable for any indirect, incidental, special, consequential, or punitive damages arising out of or related to your use of the Service.
- Our total aggregate liability to you for any claims arising from or related to the Service shall not exceed the amount you paid to us in the 12 months preceding the claim.
- We do not warrant that the Service will be uninterrupted, error-free, or free of viruses or other harmful components.
Nothing in these Terms excludes or limits liability for death or personal injury caused by negligence, fraud, or any liability that cannot be excluded or limited by law.
12. Indemnification
You agree to indemnify, defend, and hold harmless SongCraft, its officers, directors, employees, and agents from and against any claims, liabilities, damages, losses, costs, or expenses (including reasonable legal fees) arising out of or related to: (a) your use of the Service; (b) your violation of these Terms; (c) your violation of any third-party rights; or (d) Your Content.
13. Third-Party Services
Our Service may contain links to or integrations with third-party websites, services, or content. We do not control, endorse, or assume responsibility for any third-party content or services. Your use of third-party services is at your own risk and subject to those parties' terms and policies.
14. Modifications to Terms
We may update these Terms from time to time. When we make material changes, we will notify you by updating the “Last updated” date at the top of this page and, where appropriate, providing additional notice (such as a banner on our website or an email notification). Your continued use of the Service after any changes constitutes acceptance of the revised Terms.
15. Termination
We may suspend or terminate your access to the Service at any time, with or without cause, and with or without notice. Upon termination, your right to use the Service ceases immediately. Sections of these Terms that by their nature should survive termination (including, but not limited to, intellectual property, limitation of liability, and indemnification) will survive.

16. Governing Law & Disputes
These Terms are governed by and construed in accordance with the laws of England and Wales. Any disputes arising from or relating to these Terms or the Service shall be subject to the exclusive jurisdiction of the courts of England and Wales.
Before initiating any formal legal proceedings, you agree to first attempt to resolve any dispute informally by contacting us at [email protected]. We will endeavour to resolve complaints within 30 days.
17. Severability
If any provision of these Terms is found to be invalid or unenforceable by a court of competent jurisdiction, the remaining provisions shall continue in full force and effect. The invalid provision shall be modified to the minimum extent necessary to make it valid and enforceable while preserving its original intent.
18. Entire Agreement
These Terms, together with our Privacy Policy and any other policies referenced herein, constitute the entire agreement between you and SongCraft regarding your use of the Service and supersede all prior agreements, communications, and understandings.
